Will rehab be an option?

I am hoping to avoid jail time for my second DUI charge. My blood alcohol content for this DUI was .12. I paid the fines and all the terms of my first DUI which occurred about 5 years ago in 2005. Is it likely that rehab or another similar option will be available to me this time?

You need a lawyer on this one. The Law is very tough on the 2nd DUI. Although rehab may work, it is very unlikely without a lawyers help. More likely would be jail time.

It might be possible for your attorney to negotiate a plea bargain that avoids the mandatory jail time imposed on 2nd DUI. Nothing is guaranteed. Unless you could get it dismissed [rare, and unlikely], you face at least stiff fines, programs, probation, loss of license, etc. Your attorneys job is to minimize your pain.
